Ontario’s Court of Appeal has overturned a lower court ruling and upheld key parts of a provincial law aimed at protecting farms from trespassing and undercover investigations.
The legislation makes it illegal for individuals to gain employment or access to farm properties under false pretences in order to document conditions inside.
The court ruled that while undercover investigations can contribute to public debate, the law only minimally impacts freedom of expression and serves the broader goal of protecting farmers, animals, and biosecurity.
Animal Justice says it is reviewing the decision and considering a possible appeal to the Supreme Court of Canada.
